The main points dictated by the judges in the order are –
- The report indicates certain disturbing aspects about the buildings. The Commissioner of the Municipal Corporation, Faridabad shall file an affidavit recording an assurance that necessary work will be carried out in terms of the recommendations.
- till such certificates are issued by the Commissioner, the allottees are not expected to occupy the premises. Therefore it is the duty and obligation of the Municipal Corporation to ensure that solatium of Rs. 2,000/- is paid to each eligible allottee at least till the date on which the allottee is informed of the fitness certificate granted by the Commissioner in respect of the premises.
- The affidavit of the Commissioner shall also contain all details such as number of eligible persons identified so far. The Commissioner will also state the details of the exercise undertaken by the Sub-committee appointed for examining the eligibility.
- The details of the solatium paid to the eligible persons shall also be placed on record. If the Commissioner finds that the solatium has not been paid up to date to certain eligible persons, he shall ensure that the same is paid immediately.
- The Commissioner shall also ensure that either the copies of the rejection orders are supplied to the concerned persons or that the same are uploaded on the website of the Municipal Corporation.
- The counsel appearing for the Municipal Corporation states that he will file such affidavit within two months from today. Accordingly, two months time is granted. (Hence all details including the new list should be out by 14 April).
आदेश में न्यायाधीशों द्वारा निर्धारित मुख्य बिंदु हैं –
- आर्किटेक्ट की रिपोर्ट में डबुआ इमारतों के बारे में परेशान करने वाले पहलुओं का उल्लेख किया गया है। नगर निगम, फरीदाबाद के आयुक्त एक हलफनामा दायर करेंगे जिसमें यह आश्वासन दिया जाएगा कि रिपोर्ट की सिफारिशों के संदर्भ में आवश्यक कार्य किए जाएंगे।
- जब तक आयुक्त द्वारा रहने योग्य प्रमाण पत्र जारी नहीं किए जाते, तब तक आवंटियों से डबुआ में रहना शुरू करने की उम्मीद नहीं है। इसलिए यह सुनिश्चित करना नगर निगम का कर्तव्य और दायित्व है कि प्रत्येक पात्र आवंटी को कम से कम उस तारीख तक 2,000 रुपये का मुआवजा दिया जाए, जिस तारीख को आवंटी को परिसर के संबंध में आयुक्त द्वारा दिए गए फिटनेस प्रमाण पत्र के बारे में सूचित किया जाता है।
- आयुक्त के हलफनामे में अब तक पहचाने गए पात्र व्यक्तियों की संख्या जैसे सभी विवरण भी शामिल होंगे। आयुक्त पात्रता की जांच के लिए की गई उप-समिति की बैठक के विवरण का भी उल्लेख करेंगे।
- पात्र व्यक्तियों को भुगतान किए गए मुआवजे का विवरण भी रिकॉर्ड पर रखा जाएगा। यदि आयुक्त को लगता है कि कतिपय पात्र व्यक्तियों को पर्याप्त मुआवजा नहीं दिया गया है, तो वह यह सुनिश्चित करेगा कि उसका तत्काल भुगतान किया जाए।
- आयुक्त यह भी सुनिश्चित करना हैं रद्द आदेशों की कॉपी उस व्यक्तियों को प्रदान करे या उन्हें नगर निगम की वेबसाइट पर अपलोड किया जाए ।
- नगर निगम की ओर से पेश वकील ने कहा कि वह आज से दो महीने के भीतर ऐसा हलफनामा दायर करेंगे। तदनुसार, दो महीने का समय दिया जाता है। (इसलिए नई सूची सहित सभी विवरण 14 अप्रैल तक सामने आने चाहिए)।
